Robert Edens Antioch Grayslake Waukegan & BarringtonDefendant Collier was driving a tractor-trailer owned by Defendant Millstadt Rendering when he went off the roadway.  He drove through the median and ended up with a portion of his trailer sitting in the southbound lanes with its lights off.  Plaintiff Thomas Edwards was driving a tractor with a tanker-trailer owned by Slay Transportation when he collided with Defendant Trailer sitting in his lane of traffic.  Plaintiff sustained an acetabular fracture requiring open reduction with plates and screws, sciatic nerve injury resulting in foot drop and nerve surgery, multiple rib fractures, deep venous thrombosis requiring an umbrella filter and lifetime Coumadin therapy, decubitus ulcer, and depression.  Slay Transportation sought to recover $110,863 for property damages.  Defendant’s wife, Betty, claimed loss of consortium.  Plaintiff’s attorneys presented evidence that Defendant had been awake for 19.5 hours at the time of the crash.  Defendants claimed that the tractor-trailer went off the road due to an unavoidable accident resulting from failure of a drive tire and that the Plaintiff should have been able to avoid the collision.

Verdict:  $3,172.103; $2,325.00 after 7% off $2,500,000 to Thomas Edwards; $744,000 after 7% off $800,000 to Betty Edwards; $103,103 after 7% off $110,863 to Slay Transportation for property damage.
