Plaintiff was a passenger on a CTA bus when she exited the bus through the rear door at the intersection of Dodge and Crain. Plaintiff stated that the bus stopped in the middle of the street due to road construction and that when she stepped off the bus, she stepped into gravel and she lost her balance and her ankle snapped. The bus drove off without being aware of the incident. Plaintiff walked to her nearby job and then was transported to the hospital by ambulance. Plaintiff sustained a bimalleolar ankle fracture requiring open reduction and internal fixation, followed by a second surgery to remove hardware. The defense maintained that the CTA had no knowledge of the incident, that the bus never stops in the middle of the street, and that there was no road construction going on at the time Plaintiff claimed her injury was sustained. Additionally, the defense brought in the City to confirm that there was no road construction at the time of the incident.
