Summary: Defendant lost control of his vehicle and hit Plaintiff’s car head-on. Plaintiff sustained a compound fracture/dislocation of her right ankle including three tibia/fibula fractures and several torn ligaments, requiring three surgeries including insertion of a plate and screws. She suffers from a limp, no dorsiflexion of the ankle, and other permanent problems. Plaintiff was a two time U.S. National weightlifting champion who had been projected to be a member of the 2012 U.S. Olympic team. Defense contended that it is extremely difficult to predict athletic success. Defense also contended that plaintiff’s continued weightlifting was exacerbating her ongoing ankle problems.
