Summary: Two cars collided in an intersection and then struck Plaintiff’s vehicle which was stopped. Plaintiff sustained acromial impingement and arthritis in his right shoulder, minor disc herniation at L4-5, and cervical strain. Both defendants argued that the Plaintiff was not injured in the accident or was not injured to the extent claimed as he refused an ambulance at the scene and there was a nine-month gap in treatment of his shoulder.
