Plaintiff’s Medical: Dr. Stephen A. Baker (Orthopedist)
Summary: Defendant failed to completely stop at the stop line of the intersection and, instead, rolled the front of his vehicle into the crosswalk where it finally came to a stop. Plaintiff was on a bicycle and was unable to stop in time to avoid collision with the car where she sustained a fractured left tibial plateau and avulsion of the left medial collateral ligament at femoral attachment requiring future left knee replacement. Defense contended that bushes obstructed the Defendant’s view and he had to roll forward to see, his vehicle was only 1 foot into the crosswalk, and that the Plaintiff should have stopped before hitting Defendant’s car.
