ObstaclePlaintiff Tracy Walker, driver, along with Plaintiff Stacey Walker, passenger, were forced to stop their vehicle when they encountered Defendant J & L Towing’s flatbed vehicle transport truck blocking the street.  Defendant truck driver Andrade was in the process of unloading a car from the Flatbed.  Andrade allowed the owner of the car, Defendant Ward, to drive the car off the flat bed into the street.  Both Andrade and Ward were aware that the Plaintiff’s car was stopped in back of the flatbed truck.  Ward negligently drove the car down the ramp of the flat bed at an excessive rate of speed and stuck the front end of Plaintiff’s vehicle.  Tracy sustained soft tissue injuries to her right shoulder, right arm, and back.  Stacey suffered soft tissue injuries to her right arm.  The defense contended that Tracy was contributorily negligent.

Verdict:  $10,085: $6,115 to Tracy Walker ($4,281 v. Raul Andrade and J&L Towing:  $1,050 pain and suffering, $2,095 medical expenses, $95 LT, $1,040 property damage, $0 loss of normal life; $1,835 v. Ward:  $450 pain and suffering, $898 medical expenses, $41 LT, $446 property damage, $0 loss of normal life); $3,970 to Stacey Walker ($2,779 v. Raul Andrade and J&L Towing; $700 pain and suffering, $2,079 medical expenses, $0 loss of normal life; $1,191 v. Jason Ward:  $300 pain & suffering, $891 medical expenses, $0 loss of normal life.
